Abstract Disclosed is a system for charging royalty of copyrights in digital multimedia broadcasting and a method thereof. A receiving party terminal, which receives contents of music and image under control of the DMB provider's computer, stores contents on air if a start operation for recording is selected by a user's key operation or it is reservation time to start the record, and generates and outputs a royalty data of copyrights which is basic information of the copyrights fee of the stored contents to the royalty manager's computer if an end operation for recording is selected by a user's key operation, or it is reservation time to terminate the record. A royalty manager's computer calculates the copyrights fee to be paid by each user on a basis of the royal data transmitted from the receiving party terminal and transmits the calculated copyrights fee information to the DMB provider's computer. A DMB provider's computer charges each user copyrights fee on a basis of the calculated copyrights fee received from the royalty manager's computer, and provides a part of profit for the royalty manager's computer as a service charge of the calculated royalty information.
Full Text BACKGROUND OF THE INVENTION
1. Field of the Invention
The present invention relates to a system for charging
royalty of copyrights in digital multimedia broadcasting and
method thereof, more particularly to a system for charging
royalty of copyrights in digital multimedia broadcasting and
method thereof which recognize automatically a user's storage
to charge royalty when the user receiving the digital
multimedia broadcasting (DMB) stores contents of music and
image etc., through an exclusive receiving party terminal.
2. Description of the Related Art
Performance of a digital multimedia broadcasting is
drawing near which provides various multimedia signals of
high definition images and high grade music in a digital form
to a fixed receiver, a portable receiver or a receiver for
vehicle.
The digital multimedia broadcasting provides high grade
broadcasting of a CD or DVD level through a personal digital
assistant (PDA) or a terminal in a vehicle even when it is
moving. For methods for providing the broadcasting, there are
three systems which are a system A, a system Dh and a system
E. The system A obeys a standard of a European digital
broadcasting (OFDM: Orthogonal Frequency Division
Multiplexing) of a digital satellite broadcasting and a
ground wave DMB. The system Dh has a mixture method accepting
a satellite DMB on a basis of the ground wave DMB. The system
E adopts a method of a code division multiplexing (CDM) which
is almost identical to the code division multiple access
(CDMA).
This digital media broadcasting can be provided as a
ground wave DMB and a satellite DMB as mentioned later. The
ground wave DMB performs the multimedia broadcasting for a
moving terminal by using a VHF channel No.12 which is
currently on an empty state. When a channel is divided into 3
blocks, two video channels per a block are expected (or three
to four audio channels per one video channel are expected.)
and the ground wave DMB is mainly for vehicles and aimed at
free broadcasting.
Differently, the satellite DMB uses a satellite, and
users in a city with a low receiving rate receive the
broadcasting by using a relay called as Gap filler.
Approximately, this satellite DMB has a service plan with
total 39 channels comprising 11 video channels, 25 audio
channels and 3 data channels, and aims at a low price service.
However, the above mentioned digital multimedia
broadcasting service does not have a system for charging
royalty of copyrights, so that this service is very likely to
cause problems among on-line provider supplying contents
through Internet, and copyrights owners and users, and it
will be a similar problem to copyrights conflict.
SUMMARY OF THE INVENTION
To solve the above-indicated problems, it is, therefore,
an object of the present invention to provide a system for
charging royalty of copyrights in digital multimedia
broadcasting and method thereof which recognize automatically
users' storage to charge royalty when the users receiving the
digital multimedia broadcasting (DMB) store contents of music
and image etc., through an exclusive receiving party terminal.
To achieve the above object, the system for charging
royalty of copyrights in digital multimedia broadcasting
according to the present invention comprises a DMB provider's
computer for broadcasting various contents, through a
satellite or a relay, and for charging each user royalty of
copyrights on a basis of calculation information according to
storage of contents performed by users, who receive the
digital multimedia broadcasting, from a royalty manager; a
receiving terminal for displaying various contents being
transmitted under control of the DMB provider's computer, and
automatically generating royalty data of copyrights as a
result of a storage in case when the user performs storing contents on air

by storing key or reservation function by reservation key,and transmitting the generated royalty date
to the royalty manager's computer through a transmission
network (return channel); and a royalty manager's computer
for receiving the automatically generated royalty data
according to storage of contents by users from the receiving
terminal through a transmission network and calculating the
royalty, which each user should pay, on a basis of the
royalty data received from the receiving terminal, and
transmitting the calculated royalty information through the
transmission network to the DMB provider's computer.
In addition, a method of charging royalty of copyrights
in digital multimedia broadcasting comprising the steps of:
1) transmitting contents from the DMB provider's computer
through a satellite or a relay to each of receiving
terminals; 2) determining if a start of record is selected by
a user's key operation in the receiving terminal for
receiving the contents transmitted under control of the DMB
provider's computer; 3) storing the contents if the start
operation for recording is selected by the user's key
operation or it is reservation time to start the record, and
for preparing to generate a royalty data of copyrights; 4)
determining if an end operation for recording is selected by
the user's key operation in the receiving terminal storing
contents on air, or it is reservation time to terminate the
record; 5) generating royalty data, basic information of
royalty of the stored contents, by the receiving terminal, if
the end of the record is selected by the user's key operation
or it is reservation time to terminate the record, and for
transmitting the generated royalty data to the royalty
manger's computer through a transmission network (return
channel) ; 6) calculating the copyrights fee to be paid by
each user by the royalty manager's computer receiving the
royalty data from the receiving terminal and for transmitting
the calculated copyrights fee information through the
transmission network to the DMB provider's computer; and 7)
controlling to charge each user copyrights fee by the DMB
provider's computer on a basis of the calculated copyrights
fee information received from the royalty manager's computer,
and for providing a part of profit for the royalty manager's
computer as a service charge of the calculated royalty
information.

DETAILED DESCRIPTION OF THE PREFERRED EMBODIMENT
A preferred embodiment of the present invention will now
be described with reference to the accompanying drawings.
Fig. 1 is a block diagram showing schematically a
structure of a system for charging royalty of copyrights in
the digital multimedia broadcasting according to the present
invention;
As shown in the drawing, the DMB provider's computer 100
controls to transmit various contents of music and image etc.,
through a satellite or a relay to each of the receiving party
terminals 200 according to service of the satellite DMB or
the ground wave DMB, and the computer 100 receives
information of the calculated copyrights fee, which should be
paid by users having performed the storage of contents into
the receiving party terminal 200, from the royalty manger's
computer 300 after the broadcasting, and also controls to
charge each user royalty of copyrights on a basis of the
calculated copyrights fee information provided by the royalty
manager's computer 300.
Meantime, it is preferred that the above mentioned DMB
provider's computer 100 controls the charging process when
the computer charges each user royalty of copyrights on a
basis of the calculated copyrights fee information from the
royalty manager's computer 300. However, this is not a
limitation of this invention. A separate agency who deals
with a fee may charge it.
The receiving party terminal 200 displays various
contents of music and image being transmitted under control
of the DMB provider's computer 100, and automatically
generates royalty data of copyrights as a result of a storage
when a user stores (records) contents of music and image etc.
on air or with reservation, and transmits the generated
royalty data to the royalty manager's computer 300 through a
transmission network.
That is, the user does not need to perform any separate
operation for himself and the receiving party terminal 200
generates automatically royalty data of copyrights as a
result of the storage of contents and transmits the data to
the royalty provider's computer 300.
Here, the royalty data, which is generated automatically
by the receiving party terminal 200 as a result of the
storage of contents of music and image to be transmitted to
the royalty manager's computer 300, includes information of
members, the start time, the end time, information of
channels, information of contents which have been saved, and
depending on a requirement of the DMB providers, items which
are included in the royalty data can be changed.
In addition, the royalty data from the receiving party
terminal 2 00 to the royalty manager's computer 300 is
transmitted by using various return channel of two-way pager
network, mobile Internet and transmission network for mobile
telephone which performs transmission of short message and
wireless Internet.
In addition, in the receiving party terminal 200,
storage of contents is allowed only on a specific channel
which is transmitted under control of the DMB provider's
computer 100 (the specific channel can be classified with a
channel number or classified with a separate storage flag).
That is, the storage of contents can be made only on a
specific channel, similarly to a case where users should
register to be allowed to watch the pay channel.
In addition, the receiving party terminal 200 may adopt

a Digital Copyright Management or DRM solution. In the DRM solution, when specific contents
transmitted under control of the DMB provider's computer 100
is stored, the stored contents can be displayed only on the
corresponding receiving party terminal 200. In the DRM
solution, a method for encoding/decoding can be used on a
basis of ID (telephone number, ESN) of the terminal.
In addition, the receiving party terminal 200 may have
an EPG (Electronic Program Guide) where users can inquire
schedule of program on a desirable date through wireless
Internet and they can select and reserve a desirable contents
to perform storage. For example, when users connects a site
providing the EPG through wireless Internet and search
programs on a desirable date and time to select contents for
a storage, the start time and the end time of a broadcasting
of the contents are matched to perform a reservation
automatically.
In addition, when the receiving party terminal 200
stores more than a kind of contents by the operation of a
user, each contents can be separately stored as a separate
file with respect to separators between contents. For example,
in case when a user wants to store ten contents of music for an hour by a

reservation-record operation, not all the contents are stored

into one of. MP3 file, but each of contents is respectively stored into each

other MP3 files on a basis of separators which are provided between
contents of the 10 contents being on the air for an hour.
The royalty manager's computer 300 receives the
automatically generated royalty data according to storage of
contents by users from the receiving party terminal 2 00
through a transmission network and the computer calculates
the royalty, which each user should pay, on a basis of the
royalty data received from the receiving party terminal 2 00
and transmits the calculated royalty information through the
transmission network to the DMB provider's computer 300.
Here, the royalty manager's computer 300 receives a part
of the copyrights fee paid by users who stored contents from
the DMB provider's computer 100, as a service charge of
royalty information.
Fig. 2 is a block diagram showing a structure of the
receiving party terminal 200 in Fig. 1 in detail.
As shown in the drawing, a key input unit 210 outputs
key signals of various functions of the receiving party
terminal 2 00 (for example, key signal for operating power,
and a record signal for storing contents of music and image),
which is corresponding to operations of the user using the
digital multimedia broadcasting service, to a control unit
220.
The control unit 220 controls to receive various
contents under control of the DMB provider's computer 100
through a broadcasting signal receiving unit 230 and controls
to display the contents through a display unit 240 and an
audio signal outputting unit 250, and controls to store the
contents transmitted under control of the DMB provider's
computer 100 in a storing unit 2 60 when a key signal for
storing contents on air is inputted from the key input unit
210 or it is reservation time to start a record.
In addition, the control unit 22 0 controls to generate
royalty data of copyrights of contents, which has been stored
according to an user's operation, by the royalty data
generating unit 270 when a key signal for an end of the
record is inputted from the key input unit 210 or it is time
to finish the record and controls to transmit the generated
royalty data of copyrights through the royalty data
transmitting unit 280 to the royalty manager's computer 300.
Here, the control unit 220 controls to terminate a
transmission of royalty data if the control unit receives an
acknowledge data (that is, ACK signal) from the royalty
manager's computer 300 after royalty data, which is generated
automatically by a royalty data generating unit 270, is
transmitted to the royalty manager's computer 300 through the
royalty data transmission unit 280. The control unit 220
controls to resend royalty data to the royalty manager's
computer 300 predetermined number of times at intervals of
predetermined times when data if the control unit has not
received an acknowledge data from the royalty manager's
computer 300.
The broadcasting signal receiving unit 230 receives
various contents of music and image through a satellite or a
relay under control of the control unit 220.
The display unit 240 displays image data, which is
received through the broadcasting signal receiving unit 230,
on a screen under control of the control unit 220, and
displays an operation state of the receiving party terminal
200 on the screen for user's information.
The audio signal outputting unit 250 outputs music data
received through the broadcasting signal receiving unit 230,
through a speaker under control of the control unit 220.
The storing unit 260 stores contents of music and image
received through the signal receiving unit 23 0 under control
of the control unit 22 0, and the unit outputs the stored
contents according to a request of the control unit 220.
The royalty data generating unit 270 generates
automatically royalty data of copyrights of contents which
has been stored into the storing unit 260 under control of
the control unit 22 0, outputting it to the royalty data
transmission unit 280.
The royalty data transmission unit 280 transmits royalty
data, generated automatically through the royalty data
generating unit 270 under control of the control unit 220,
through a transmission network (return channel) to the
royalty manager's computer 300.
Fig. 3 is a block diagram showing a structure of the
royalty manager's computer 300 in Fig. 1.
As shown in the drawing, a data transmission unit 310
receives royalty data, which is generated automatically
according to a user's storage of contents, from the
receiving party terminal 200 through a transmission network
to output the data to a control unit 320, and the unit
transmits an acknowledge data for acknowledging receipt of
royalty data inputted from the control unit 320, to the
receiving party terminal 200, and the unit transmits
copyrights fee information of each user, which is calculated
on a basis of the royalty data received from the receiving
party terminal 200, to the DMB provider's computer 3 00 under
control of the control unit 320, and receives an acknowledge
signal acknowledging receipt of the calculated copyrights
fee information of each user from the DMB provider's
computer 300 to output it to the control unit 320.
The control unit 320 controls to calculate copyrights
fee, which each user should pay, on a basis of royalty data
received from the receiving party terminal 2 00 through the
data transmission 310, and controls to transmit royalty
information, which each user should pay, through the data
transmission unit 310 to the DMB provider's computer 300.
Under control of the control unit 32 0, a copyrights fee
calculating unit 330 calculates copyrights fee, which each
user should pay, on a basis of royalty data which is
received from the receiving party terminal 2 00 through the
data transmission unit 310.
A database 340 stores information of copyrights fee
about contents of music and image etc., and information of
broadcasting program transmitted from the DMB provider's
computer 100, and the database stores copyrights fee
information of each user, which is calculated by the
copyrights fee calculating unit 33 0, under control of the
control unit 320.
Now, an embodiment of the method of charging royalty of
copyrights in digital multimedia broadcasting according to
the present invention will be described with reference to
Fig. 4. Fig. 4 is a sequence diagram showing in detail a
process of the method of charging royalty.
First, contents of music and images are transmitted
under control of the DMB provider's computer 100 through a
satellite or a relay to each of the receiving party
terminals 200 of users receiving the digital multimedia
broadcasting service (S105).
The receiving party terminal 2 00 which receives
contents under control of the DMB provider's computer 100
determines if a start of record of contents on air is
selected through an user's key operation or it is
reservation time to start a record (S110).
As a result of the determination, if the start of
record is selected by the user's key operation or it is
reservation time to start a record, the receiving party
terminal 200 determines if it is possible to store the
corresponding contents (S115).
If it is possible to store the corresponding contents,
the receiving party terminal 200 stores contents transmitted
under control of the DMB provider's computer 100 and the
terminal prepares to create royalty data of copyrights
(S120) .
However, if it is not possible to store the
corresponding contents as the result of determination at
step of S115, the receiving party terminal 200 shows message
of informing user of impossibility of the storage, on screen
(S125) .
The receiving party terminal 2 00 determines if an end
of record is selected by the user's key operation, or it is
reservation time to terminate the record (S130).
As a result of the determination, if the end of record
is selected by the user's key operation or it is reservation
time to terminate the record, the receiving part terminal
200 performs storing function until contents on air have fully stored, and then generated
royalty data which is basic information of copyrights fee of
contents stored by the user (S140) . Here, the royalty data
includes information of members, the start time, the end
time, information of channels, information of contents that
have been stored.
The receiving party terminal 200 transmits royalty data,
which is generated automatically according to the storage of
contents, through a transmission network (return channel) to
the royalty manager's computer 300 (S145), and determines if
data of acknowledging receipt of royalty data is received
from the royalty manager's computer 300 (S150). If the data
of acknowledging receipt of royalty data is received from
the royalty manager's computer 300, the receiving party
terminal 200 terminates the storage of contents and displays
message of informing user of success of the storage on
screen (S155)
However, if the data of acknowledging receipt of
royalty data has not been received from the royalty
manager's computer as a result of determination of the above
step S150, the receiving party terminal 200 resend the
royalty data to the royalty manager's computer 300
predetermined number of times at intervals of predetermined
time, and then deletes the stored contents and displays a
message of informing failure of the storage on screen if the
acknowledge data is not received within predetermined times
(S160) .
Then, the royalty manager's computer 300 calculates fee
of copyrights, which each user should pay, on a basis of the
royalty data received from the receiving party terminal 200
(S165). That is, the computer calculates the copyrights fee
by a comparison of information of contents transmitted under
control of the DMB provider's computer 100 and royalty data
received from the receiving party terminal 200.
The royalty manager's computer 300 transmits the
calculated information of copyrights fee through various
return channels such as a transmission network for mobile
telephone, wireless Internet and two-way pager network etc.,
to the DMB provider's computer 100 (S170) . The DMB
provider's computer 100, which received the calculated
information of copyrights fee from the royalty manager's
computer 300, controls to charge each user the copyrights
fee on the basis of the information (S175) .
The DMB provider's computer 100 offers a part of profit
of copyrights fee received from each user, to the royalty
manager's computer 300 as a service charge of the calculated
information of copyrights fee (S180).
As mentioned above, according to the system for charging
royalty of copyrights in digital multimedia broadcasting and
method thereof, when a user stores contents of music and
images by an user's record operation or reservation for a
storage into the receiving party terminal while receiving
digital multimedia broadcasting through an exclusive
receiving party terminal, the user or the DMB provider does
not need to perform a separate operation for a royalty, and a
calculation for charging royalty of copyrights which each
user should pay can be performed automatically by the royalty
manager.
In addition, the present invention automates a process
for charging the copyrights resulting from the storage of
contents, thereby preventing conflict between providers and
users related to the copyrights fee and increasing income of
the copyrights fee of the DMB provider, the copyright owner
and the royalty manager.
While the invention has been shown and described with
